DIF Broker, SA, its subsidiaries and branches (hereinafter, "DIF Broker"), registered and monitored in various jurisdictions, adopted a series of measures to protect the privacy of customers and users of the DIF Broker website, with the firm intention of demonstrating their commitment and respect to the simultaneous protection of confidentiality and privacy of the information entrusted to them, both by current and potential clients, ensuring the protection and proper use of personal data ("personal data") transmitted to them, and having prepared this Privacy and Data Protection Policy. These policies apply to companies and websites owned and/or managed by the DIF Broker entities.

1. Collection and Processing of Personal Data:

  1. For this purpose, personal data shall be considered any information, regardless of its nature or support, relating to an identified or identifiable individual (the holder of the personal data).

Personal data provided both by current and potential clients, collected directly or indirectly by DIF Broker as well as those resulting from access, transactions or other records related to the contract between DIF Broker and the Client, carried out with or without automated resources and means, within the framework of the business relationship established with DIF Broker, which may be transmitted to third parties duly authorized for this purpose.
  3. The entity responsible for data collection and processing is DIF Broker, with whom the client or user has signed their contract when registering or has accepted the conditions of use, being subject to the regulations of each jurisdiction. There may be legal specificities in terms of data protection, depending on the jurisdiction of DIF Broker with whom the client or user entered into their contract.
  4. Personal data shall be collected when so agreed by the holder. The fact that the holder provides his/her personal data implies knowledge and acceptance of the conditions included in this Privacy Policy. By virtue of the above, the Client, when providing his/her personal data, at the same time authorizes the collection, use, and making available of such information in accordance with the regulations under the applicable collection instruments.
  5. Within the framework of the Data Protection Law, the holder of his/her personal data (the Client) is guaranteed to exercise his/her rights of access, rectification, deletion (right of forgetting), limitation, portability, and opposition of his/her personal data, through written communication addressed to the DIF Broker with whom the client registered:

  6. Likewise, within the scope of the Personal Data Protection Law, the client has the right to oppose to the use of the information he/she has provided for marketing initiatives, to receive informative communications, or to be included in lists or information services. In order to exercise this right of opposition, the client must state his/her willingness to be removed from the aforementioned database for marketing initiatives, at the "Unsubscribe" option in automatic notifications. The client's e-mail available during the account opening process is used to communicate events related to the products and services offered to the client. You may only remove this email for marketing initiatives.

  7. DIF Broker shall process the client’s personal data in accordance with the principles established in the legislation on protection of personal data, in particular, with the provisions of EU Regulation 2016/679 of the European Parliament and Council, dated April 27 (General Regulation on Data Protection), enforceable as of May 25, 2018.

2. Personal Data Protection:

  1. DIF Broker shall adopt the appropriate technical and organizational measures to guarantee the protection of said information against accidental or unlawful destruction, accidental loss, alteration, disclosure, or unauthorized access, as well as against any other form of illicit processing of personal data.
  2. Considering that personal information is collected and/or processed through an open network (Internet), the client must be aware that there is no guarantee of inviolability of their personal data in the process of transmitting this information. Therefore, there is a risk that such personal data may be consulted and/or misused by unauthorized third parties, despite all the measures taken by DIF Broker to avoid this scenario. DIF Broker shall not be responsible for the information of other organizations or persons referred through links.
  3. Provider entities or licensees of services to DIF Broker, including entities based in the territory of the European Union, may access to personal data collected or registered by DIF Broker, when and to the extent necessary for the offer to the client of products or services marketed by DIF Broker or when it is essential for the fulfillment of contractual obligations established between DIF Broker and the client.
  4. DIF Broker shall not provide third parties with the personal information provided by the client for purposes other than those already included in this Privacy Policy, except in the following circumstances:
    •    in cases of legal notifications, court orders, or judicial processes in which the availability of such personal data is requested;
    •    when the provision of the aforementioned personal data is based on compliance with DIF Broker’s legal obligations.
  5. All the DIF Broker workers, directors, and advisors are legally obliged to treat personal data confidentially and, in any case, they may use it beyond their legal obligations.

3. Security of Personal Data:

DIF Broker has a set of technologies for the protection of personal data provided by its customers against possible illicit practices developed through unauthorized access, use, or disclosure of such data. When such protection is considered necessary, DIF Broker proceeds, for example, to the storage of said personal data in computer systems with limited access. In addition, DIF Broker ensures that stored personal information is protected by encryption due to the adoption of the SSL (Secure Socket Layer) protocol.

4. Use of Cookies:

  1. DIF Broker websites use cookies. The use of this type of files allows those in charge of the website to understand how it is used, facilitates navigation on the website, and stores the user preferences. In general, cookies provide a better user experience, ensuring that the website offers its users relevant content.
  2. As mentioned in the current Cookies Policy adopted by DIF Broker, most Internet browsers give users the possibility to accept, reject, or delete cookies, in particular by selecting the appropriate definitions in their browser. Although, at first, the user may authorize the use of cookies, he/she may, at any time, deactivate most of the cookies used. However, the user is warned that by disabling the use of cookies on DIF Broker entities’ websites it is possible that they may not experience all the potentialities and functionalities provided by the website.

5. Amendments to the Privacy Policy:

DIF Broker reserves the right to introduce, at any time, readjustments or amendments to this Privacy Policy. Therefore, we recommend that you periodically consult this policy so that you are kept informed about how DIF Broker guarantees the protection of the personal data provided. The material changes introduced shall only apply to activities or data collected in the future.

6. Exercise of Rights:
